Structure of the Judiciary:
Pakistan has a hierarchical three-tiered judiciary system:-
Supreme Court of Pakistan: The apex court of the country, consisting of two main branches: the Supreme Court and the Chief Court of Gilgit-Baltistan.
High Courts: Each province in Pakistan has its own high court.
District Courts: At the lowest level, there are district and sessions courts in each district.
Judicial Independence:
The judiciary in Pakistan is supposed to be independent and impartial, ensuring separation of powers and checks and balances among the three branches of government—executive, legislative, and judiciary.
Judicial Appointments:
The judiciary is appointed through a structured process. The Chief Justice of Pakistan is appointed by the President, and other judges of the Supreme Court are appointed by the President on the advice of the Chief Justice. High court judges are appointed by the President in consultation with the Chief Justice of Pakistan and the provincial Chief Justices.
Law System:
Pakistan follows a common law system, which is largely based on the English legal system. The legal system comprises statutes, case law, and Islamic law principles, particularly in matters related to family and personal law.
Islamic Law (Sharia):
Pakistan is an Islamic republic, and the legal system includes Islamic law, particularly in matters such as family law, inheritance, and personal status. Sharia principles are primarily enforced through specialized courts known as Sharia Courts.
Courts’ Jurisdiction:
The Supreme Court has appellate jurisdiction over high courts and other federal and provincial courts. High courts have appellate and original jurisdiction over district and other lower courts within their respective jurisdictions.
Legal Codes:
Pakistan has various legal codes, including the Pakistan Penal Code (PPC) for criminal law, the Code of Criminal Procedure (CrPC) for criminal procedure, and the Civil Procedure Code (CPC) for civil cases.
Legal Reforms and Challenges:
Pakistan has been striving for legal reforms to enhance access to justice, improve the efficiency of the legal system, and ensure protection of human rights. Challenges include a backlog of cases, delays in the legal process, corruption, and a need for legal education and awareness.
Legal Profession:
The legal profession in Pakistan is regulated by the Pakistan Bar Council (PBC) and provincial bar councils. Lawyers are required to be members of the respective bar council to practice law.
